Nintendo has filed a lawsuit against accessory manufacturer Genki for trademark infringement after the company shared renders of an unofficial Nintendo Switch 2 mockup months before Nintendo's official console reveal.
Recall that earlier this year, Genki became embroiled in controversy during CES 2025 when it showcased what it claimed was a Switch 2 mockup. Despite reported visits from Nintendo's legal team, Genki maintained it hadn't signed any nondisclosure agreement and therefore had "no concerns."
The company told attendees its mockup - revealed three months before Nintendo's official announcement - was purportedly based on a genuine Switch 2 unit they'd examined for accessory development.
According to court documents obtained by IGN, Nintendo alleges Genki launched "a calculated campaign to exploit public anticipation for Nintendo's next-generation console," filing claims for trademark violation, unfair competition, and deceptive marketing.
Nintendo claims Genki "touted supposed early hands-on experience with the unreleased hardware" and permitted event-goers to handle the mockups. The gaming giant argues Genki's compatibility claims "would require illegal, unauthorized access to Switch 2 hardware," thereby "misleading consumers about product compatibility guarantees."
"In January 2025, [Genki] advertised having unapproved access to Nintendo's forthcoming Switch 2 console before its official announcement or release," state the legal filings.
"After initially claiming possession of actual hardware, Defendant issued conflicting statements before ultimately insisting they never had a console. Despite this, Genki continues assuring customers its accessories will work with Switch 2 at launch."

Nintendo further alleges Genki violated trademarks in promotional materials and competed unfairly with Nintendo's official licensee accessory program.
The complaint cites a January 20 Genki tweet showing CEO Edward Tsai miming secrecy with the caption: "Genki ninjas infiltrate Nintendo Kyoto HQ," plus a website popup reading: "Can you keep a secret? We can't..."
Nintendo seeks court orders preventing Genki from using "Nintendo Switch" branding, mandating destruction of infringing materials, and awarding unspecified damages - potentially tripled - for the alleged violations.
Genki recently responded via social media: "We're aware of Nintendo's lawsuit and are consulting legal advisors to prepare an appropriate response."
"Genki remains an independent company dedicated to creating innovative gaming accessories for our community. We stand by our products' quality and originality. While we can't elaborate, we're proceeding with production and will exhibit at PAX East this week."
The statement concluded by thanking supporters and affirming their focus remains on "developing premium gaming gear."
The Nintendo Switch 2 launches June 5, with pre-orders opening April 24 at $449.99 - creating the expected frenzy. Nintendo has cautioned U.S. customers that My Nintendo Store pre-orders may not arrive on launch day due to extraordinary demand.
